Followup to July Newsletter - Statement on Dogs in Merriman Park from MBEA Board President Joe Sciacca

The park is owned by a park district created by the town of North Hempstead (I can provide anyone with a copy of the deed upon request). The park is not owned by the MBEA. Since the park is owned by a park district it is governed by the rules of the Town of North Hempstead with respect to parks. You can obtain a copy of the rules for all parks in the North Hempstead offices on Plandome Road in Manhasset.

In particular, Chapter 39, Article I, section 13, titled "Animals", states "It shall be unlawful for any person owning or being custodian of any animal to cause or permit such animal to enter a park or enter onto a town dock, except that a person visually handicapped may bring a Seeing Eye dog into a park or onto a town dock."].

No dogs are allowed in any of the parks. As an example you cannot bring a dog into Manorhaven Park. Likewise it is illegal to bring a dog into Pine Park. We as an association cannot change the laws of the Town of North Hempstead or provide our own rules concerning dogs in the park. The Town of North Hempstead has provided for dogs by having a dog run at Christopher Morley Park. The Port Washington police asked me to include a notice in our mailing that was just sent out to advise park users that they would start issuing summonses to those that continued to violate the law. I have attempted to warn those that continue to violate the law that they would be facing fines. I have received numerous complaints from individuals about dogs in the park. The police have also received complaints. Since we cannot change the law the only reasonable alternative is that all comply with the law. It is unfortunate that people believe that there is a controversy about dogs in the park. To me the law is clear. No dogs are allowed in the park. Before my wife severely injured her leg we had a dog and at no time did I ever take the dog to Pine Park nor did I take the dog to Manorhaven Park. I am convinced that dog owners can find alternatives to violating the law and imposing their wishes on those that, for numerous reasons, want the park free of dogs as the law requires.
